Bulletin: Keith Kutska: (Monfils Six); Wisconsin; State oppose a new trial on basis, among other submissions, that Tom Monfils, whose body was found in a pulp vat at the Green Bay paper mill where they all worked in 1992, may have killed himself is "flimsy."..." Kutska’s lawyers argue Monfils may have killed himself, but a judge said there wasn’t enough evidence to prove that. Wisconsin Attorney General Brad Schimel responded to the appeal, calling the suicide theory “so flimsy and unconvincing that no reasonable jury could have seriously entertained any doubt that he was murdered.” He tells the court in his motion, “The mere fact that 20 years after this conviction Kutska has dredged up evidence that was not presented at his trial is not a reason to give him a new trial.”"

"The State of Wisconsin filed a motion Friday responding to Keith Kutska’s latest attempt to get a new trial. Kutska and five other men, often referred to as the “Monfils Six,” were convicted of killing Tom Monfils, whose body was found in a pulp vat at the Green Bay paper mill where they all worked in 1992. Kutska, who prosecutors portrayed as the leader, is serving a life sentence. In February his attorneys appealed a judge’s ruling that denied Kutska a new trial. Kutska’s lawyers argue Monfils may have killed himself, but a judge said there wasn’t enough evidence to prove that. Wisconsin Attorney General Brad Schimel responded to the appeal, calling the suicide theory “so flimsy and unconvincing that no reasonable jury could have seriously entertained any doubt that he was murdered.” He tells the court in his motion, “The mere fact that 20 years after this conviction Kutska has dredged up evidence that was not presented at his trial is not a reason to give him a new trial.”..."Only one of the defendants, Michael Piaskowski, had his conviction overturned."

See a previous post of this Blog (March 24, 2016)  at the link below: "Keith Kutska; Wisconsin; Murder or suicide? He has appealed to Wisconsin’s Third District Court of Appeals seeking to overturn a judge’s decision to not grant him a new trial for the murder of Tom Monfils. "In a July hearing, Kutska's new team of lawyers argued that his lawyer at trial and his appeals lawyer were incompetent because they relied too heavily on findings by pathologist Dr. Helen Young, who investigated Monfils' death. Young concluded major injuries on Monfils' body must have occurred before he was put in the pulp vat, indicating he had been beaten. They also argued a theory that Monfils committed suicide wasn’t properly presented at Kutska's trial and that a detective investigating the case bullied witnesses into giving false statements."
