Bulletin: Gerald Barton; Nova Scotia; RCMP lawyer argues that there is no evidence that the force was negligent in the wrongful conviction. Canadian Press;


STORY: "No evidence of RCMP negligence in case of wrongfully convicted man, lawyer," reported by Canadian Press, published on April 10, 2014.

GIST: A federal lawyer says a Nova Scotia man has failed to prove he was wrongfully convicted of statutory rape in 1970 as the result of a negligent investigation by the RCMP. Angela Green told the Nova Scotia Supreme Court on Thursday that Gerald Barton's lawyer failed to present any evidence that the lead investigator in the case failed to meet a common sense standard of care. In her closing argument, Green said there was no evidence to suggest Earl Hamilton -- a corporal at the time in Digby who retired as an inspector -- was careless in his work or that he fabricated an incriminating statement attributed to Barton, who was 19 at the time."

Two Blogs Now: The Charles Smith Blog; The Selfless Warriors Blog: I created the Charles Smith Blog in 2007 after I retired from The Toronto Star to permit me to keep digging into the story of the flawed pathologist and the harm he had done to so many innocent parents and caregivers, and to Ontario’s criminal justice system. Since then it has taken new directions, including examinations of other flawed pathologists, flawed pathology, and flawed science and technology which has marred the quality of justice in courtrooms around the world. On International Wrongful Conviction Day in 2024, I was thrilled to have the Blog recognized by Innocence Canada, when I was presented with the, "Rubin Hurricane Carter Champion of Justice Award." The heart of the Blog is my approach to following cases which raise issues in all of these areas - especially those involving the death penalty.
