‘Take Care of Maya’ trial: Bulletin: Still no verdict yet in $220M case against All Children’s Hospital, Fox 13 (Reporter Kimberly Kuizon) reports…"John Hopkins All Children’s Hospital said the case will have impacts across the medical world. "We believe on behalf of the hospital, the hospital practiced safe evidence base medicine, and we are here to defend the hospital’s rights to defend practicing medicine," said defense attorney Ethen Shapiro. " The Kowalski family said the actions of the hospital not only took her mother away from her, but forever altered their lives in unimaginable ways. "Your job is to figure out how it happened to them and what ends up being justice for them," said Kowalski family attorney Gregory Anderson…”

PASSAGE OF THE DAY: "Maya Kowalski, along with her brother Kyle and father Jack remained in the South Sarasota County courthouse waiting for any word from the jury.  The jury is made up of four women and two men, and they are deliberating over seven claims, including false imprisonment, battery and medical negligence. If the jury sides with the family they’ll then have to decide punitive damages as well as future losses the family would likely suffer.  That could require more testimony.  "If there is time to do anything in that punitive damages case, if we get to the punitive damage case I am going to want to do it," said Judge Carroll."

STORY: "'Take Care of Maya' trial: Still no verdict yet in $220M case against All Children's Hospital," by Reporter Kimberly Kuizon, published by Fox 13 news, on November 8, 2023.

GIST:"VENICE, Fla. - The jury continued deliberating Wednesday in the $220 million case against Johns Hopkins All Children's Hospital that was the premise of the Netflix documentary "Take Care of Maya."

Judge Hunter Carroll gave a hard deadline of 4 p.m. for the jury to stop deliberating for the day. That deadline passed Wednesday afternoon without a verdict being reached, but jurors will return Thursday morning.

"I think from the moment, we know the jury is coming in there is still going to be a period of time that we are dealing with this verdict form," Judge Carroll told the court.

Judge Carroll told the court when the verdict is reached, it’ll take at least half an hour for it to read.

FINAL WORD: (Applicable to all of our wrongful conviction cases): "Whenever there is a wrongful conviction, it exposes errors in our criminal legal system, and we hope that this case — and lessons from it — can prevent future injustices.

Lawyer Radha Natarajan;

Executive Director: New England Innocence Project;

FINAL, FINAL WORD: "Since its inception, the Innocence Project has pushed the criminal legal system to confront and correct the laws and policies that cause and contribute to wrongful convictions. They never shied away from the hard cases — the ones involving eyewitness identifications, confessions, and bite marks. Instead, in the course of presenting scientific evidence of innocence, they've exposed the unreliability of evidence that was, for centuries, deemed untouchable." So true!

YET ANOTHER FINAL WORD:

David Hammond, one of Broadwater’s attorneys who sought his exoneration, told the Syracuse Post-Standard, “Sprinkle some junk science onto a faulty identification, and it’s the perfect recipe for a wrongful conviction.”
