Bulletin: Beleaguered Lehigh Valley Health Network: Dr. Debra Esernio-Jenssen; Pennsylvania: Another civil complaint has been filed against Lehigh Valley Health Network and one of its pediatricians, who has been accused of intentionally misdiagnosing child abuse, wfmz.com reports - alleging that a couple lost custody of their newborn due to the LHVN pediatrician's false analysis…"Tyler Mackie-Stuber and Hailey Stuber say they took their 3-week-old daughter to the emergency room in June 2021 after they noticed what appeared to be bruising on her body, the suit states. The couple says Jenssen and another doctor ignored the baby's abnormal blood work results and the rash, all of which indicated a medical issue, and instead accused the parents of child abuse. The baby also had x-rays done, and Jenssen "erroneously" took the radiologist's findings to mean the newborn had suffered a leg fracture caused by abuse, the complaint claims."

PASSAGE OF THE DAY:  "Jenssen filed a child abuse report against the parents, and the Stubers lost custody of their baby for nearly one year, they say. Jenssen continued the child abuse case even after several other doctors in the next few months found no fractures or concern for abuse.

The lawsuit says that when it came time for Jenssen to testify under oath in the custody case, she did not appear and the case was dismissed, and the case was ruled to be unfounded. Defendants named in the lawsuit include Jenssen, another doctor, LVHN and various affiliated healthcare facilities — including Jefferson Health, with which the network is expected to merge later this year. The suit also lists what it says are a long list of complaints against Jenssen from her work as a pediatrician in New York and Florida, and says LVHN ignored warnings about her."

PASSAGE TWO OF THE DAY: "Jenssen used to be the medical director of LVHN's John Van Brakle Child Advocacy Center (CAC), but has since been replaced. She is still employed with the health network. This is the third lawsuit filed against Jenssen. Like the first two, it was filed by attorney Tom Bosworth of Philadelphia-based Tom Bosworth Law."

STORY:  Whitehall couple lost custody of newborn due to LVHN pediatrician's false diagnosis, lawsuit
says, published by WFMZ.com, on January 31, 2024.

GIST: "Another civil complaint has been filed against Lehigh Valley Health Network and one of its pediatricians, who has been accused of intentionally misdiagnosing child abuse.

A Whitehall couple says they lost custody of their newborn daughter for a year because of Dr. Debra Esernio-Jenssen's false child abuse claims, the suit says.

Tyler Mackie-Stuber and Hailey Stuber say they took their 3-week-old daughter to the emergency room in June 2021 after they noticed what appeared to be bruising on her body, the suit states.

The couple says Jenssen and another doctor ignored the baby's abnormal blood work results and the rash, all of which indicated a medical issue, and instead accused the parents of child abuse.

The baby also had x-rays done, and Jenssen "erroneously" took the radiologist's findings to mean the newborn had suffered a leg fracture caused by abuse, the complaint claims.

Jenssen filed a child abuse report against the parents, and the Stubers lost custody of their baby for nearly one year, they say.

The suit also lists what it says are a long list of complaints against Jenssen from her work as a pediatrician in New York and Florida, and says LVHN ignored warnings about her.

Jenssen used to be the medical director of LVHN's John Van Brakle Child Advocacy Center (CAC), but has since been replaced. She is still employed with the health network.

This is the third lawsuit filed against Jenssen. Like the first two, it was filed by attorney Tom Bosworth of Philadelphia-based Tom Bosworth Law.

LVHN says it does not comment on active legal matters."

FINAL WORD: (Applicable to all of our wrongful conviction cases): "Whenever there is a wrongful conviction, it exposes errors in our criminal legal system, and we hope that this case — and lessons from it — can prevent future injustices.

Lawyer Radha Natarajan;

Executive Director: New England Innocence Project;

FINAL, FINAL WORD: "Since its inception, the Innocence Project has pushed the criminal legal system to confront and correct the laws and policies that cause and contribute to wrongful convictions. They never shied away from the hard cases — the ones involving eyewitness identifications, confessions, and bite marks. Instead, in the course of presenting scientific evidence of innocence, they've exposed the unreliability of evidence that was, for centuries, deemed untouchable." So true!

YET ANOTHER FINAL WORD:

David Hammond, one of Broadwater's attorneys who sought his exoneration, told the Syracuse Post-Standard, "Sprinkle some junk science onto a faulty identification, and it's the perfect recipe for a wrongful conviction.
