STORY: Texas Supreme Court opts to allow Roberson to testify Monday, CBS Austin (Reporter Jahmal Kennedy) reports.
GIST: "The Texas Supreme Court ruling late Sunday night said (sic) it will allow Texas Death Row inmate Robert Roberson to testify Monday just days after his execution was stayed.
Texas Attorney General Ken Paxton looked to get the Supreme Court to reverse its decision before Monday’s testimony, arguing that staying Roberson’s execution sets a bad precedent for the future.
“This is like a situation where we’ve had the people who’re involved with his case years ago with the prosecution saying now that they made mistakes,” said Rep. Donna Howard.
Howard spoke before the TSC’s ruling, calling Roberson’s circumstances monumental.
“There’s no reason that we should not be reviewing this and so I’m really kind of stunned that it took this kind of extraordinary effort to make that happen but again I am eternally grateful to my colleagues,” she said.
A bipartisan effort from Texas Democrats and Republicans pushed the court to hold the execution for now, citing faulty evidence.
Roberson is on death row for the death of his 2-year-old daughter back in 2002, citing shaken baby syndrome. If executed, he would be the first person in the country to be executed for a crime tied to a diagnosis of shaken baby syndrome."
