Mark Lundy: New Zealand; The Privy Council in London is to deliver judgment on his murder appeal tomorrow - Monday 7 October, 2013; His lawyers argued that prosecutors relied on "bad science" to assess the DNA evidence and to determine the time of death; NZ City.

GIST: "Double murderer Mark Lundy will learn his fate on Monday, with the Privy Council in London due to deliver its verdict on his final freedom bid. Lundy was granted permission in February to appeal his conviction for killing his wife Christine and seven-year-old daughter Amber to the Privy Council. The mother and daughter died in a brutal attack at their Palmerston North home in 2000. Lundy was found guilty by jury of their murders and has so far served 11 years of a 20-year jail sentence. In June, the Privy Council held a hearing on his appeal against his conviction where Lundy's lawyers argued that the crown case relied on "bad science". David Hislop QC said the methods used to assess DNA evidence and to establish time of death were unreliable according to a number of experts, and that this had not been made clear to the jury. However, deputy solicitor-general Cameron Mander said opinions questioning the scientific testing had been available at the time of the trial and the defence deliberately chose not to present them. Lundy's lawyers placed emphasis on the police timeline, and say the suggested time of death between 7pm and 7.15pm is crucial to proving Lundy was the killer. Mr Mander disputed that, saying the unreliability of the time of death testing was well canvassed during the trial, and the jury still reached a guilty verdict."

The appeal was based on three issues: the time of death, the time of shutdown of Christine's computer, and the presence of brain tissue on Lundy's shirt.[18] The hearing before the Privy Council (including New Zealand's chief justice Dame Sian Elias) began on June 17, 2013.
