Lacey Spears: New York; Whether boy suffered seizures has become an issue at the trial - but the significance of whether he was having seizures was not addressed during Wednesday's proceedings. Journal News.

GIST:  "Garnett Spears had a sodium level so high it was "not compatible with life" four days before he died, a doctor brought in to consult on the child's case testified Wednesday at his mother's murder trial. "The child was very sick. I did not think he was having seizures," Dr. Ariel Sherbani said about his exam of Garnett on the evening of Jan. 19, 2014, at Nyack Hospital. "I was very concerned.".........Under questioning by Westchester Assistant District Attorney Patricia Murphy, Sherbani said he was "puzzled" by what Lacey Spears described as seizures her son had as an infant, when she said his sodium level was found to be even higher than it was at Nyack Hospital. "I couldn't understand what it was," he said. "I asked her if she was sure, because it's such a high level it's not compatible with life."".........Also testifying was Dr. Neelina Thakur, an epilepsy expert, who monitored Garnett's EEG on Jan. 18 and 19 and found "nothing to suggest that he was having seizures." The significance of whether he was having seizures was not addressed during Wednesday's proceedings. The trial was adjourned until Friday morning."

A few days before the appeal, and 11 years after he was found guilty, a report by a neuropathologist questioning the reliability of the 'brain tissue' was given to Lundy's legal team. Police failed to disclose the report to his defence lawyers, or to the court, at the time of the trial.[26] The Privy Council found that the science used to identify the speck of tissue found on Mark Lundy's polo shirt was controversial and there was reason to doubt its accuracy.[27] Other issues before the Council included the time of shutdown of Christine's computer, and the examination of stomach contents used to determine the time of death.[28] Mr Lundy's legal team submitted that examination of stomach content to determine time of death was internationally discredited as bad science.[29] The hearing which included Chief Justice of New Zealand Dame Sian Elias) began on 17 June 2013. The Privy Council announced its decision in October 2013, declaring Lundy's convictions "unsafe" in light of the new evidence, quashed the convictions and ordered a retrial.[30] Lundy is to be retried in the High Court In Wellington beginning on 9 February, 2015 in a hearing expected to take six weeks."
