Alison Dorsey: Iowa: Major (Welcome) Development: Shaken Baby Syndrome: Bulletin: The Iowa day care provider has been released from prison after her conviction was reversed, KCCI reports, noting that: Prosecutors say 11-week-old Luka Hodges died from severe brain hemorrhages caused by "shaken baby syndrome" in 2019. Dorsey's attorneys argued she did not get a fair trial and the injuries occurred before the baby was dropped off at day care."



BACKGROUND:  From a previous post of this Blog:  "Major (Welcome) Development: Shaken Baby Syndrome: Her first trial ended in a mistrial (hung jury) on a charge of first-degree murder in the death of an 11-week-old infant in her care; Her second trial recently ended in a conviction, and a sentence of 50 years in prison (with a mandatory minimum of 35 years before she is eligible for parole) and a restitution order for $150,000. Now, however, The Iowa Supreme Court has ruled that she should get a new trial, after her lawyers contended that the prosecution had improperly 'jury venue' shopped, The Atlantic News Telegraph (Publisher Jeff Lindquist) reports…"In her appeal, her attorneys also argued that the verdict was not supported by “substantial evidence, evidence of a child’s rib injury was improperly admitted, she was deprived of her right to call witnesses about relevant character traits, and the court erred in denying her motion for a new trial.” On Friday the Supreme Court, by a 3-2 vote with two justices not participating, agreed the state should not have moved the trial."

GIST: "A Massena woman who was serving time for the death of a baby she cared for at her in-home day care, is now out of prison.

The Iowa Supreme Court reversed her conviction last month.

She was serving a 50-year prison sentence after a jury found her guilty of second-degree murder and child endangerment resulting in death back in 2023.

That was her second trial. The first ended with a hung jury.

Prosecutors say 11-week-old Luka Hodges died from severe brain hemorrhages caused by "shaken baby syndrome" in 2019.

Dorsey's attorneys argued she did not get a fair trial and the injuries occurred before the baby was dropped off at day care.

The Iowa Supreme Court granted her a third trial.

A date has not been set."
