Bulletin: Rene Bailey; New York: The Democrat and Chronicle reports that the former day care provider testified Tuesday that a boy in her care likely saw a fatal fall of a toddler, who authorities instead insisted was killed by violent shaking.

GIST: A former day care provider testified Tuesday that a boy in her care likely saw a fatal fall of a toddler, who authorities instead insisted was killed by violent shaking. Monroe County Court Judge James Piampiano, who is considering a bid to reverse a "shaken-baby syndrome" conviction of René Bailey, now must decide whether the testimony is credible and is new to the criminal case. Bailey was convicted in 2002 of murder in the death of 2½year-old Brittney Sheets, who was in Bailey's care in her Greece home. A jury decided that Bailey shook Brittney to death. In the aftermath of the death, a boy who was also in Bailey's care and about the same age as Brittney was moved for day care to the home of Sandra Hennessy, who then lived in Gates. That boy, Hennessy testified Wednesday, began re-enacting what appeared to be the events of Brittney's death. He would encourage an imaginary Brittney to jump from a chair, then would run to a location as if Brittney were there. He would carry a pink toy pig he kept, said Hennessy, who now lives in Florida. "As far as his pig was concerned, it had magical powers to him," Hennessy said. Bailey has maintained that Brittney suffered injuries from a fall off of a chair. She said that she was in a bathroom when she heard the boy say, "Jump Brittney, I know you can do it." Bailey said she heard two thumps and came out to find Brittney lying on the floor. At the crux of the debate is what has become warring scientific opinions over whether the injuries suffered by Brittney could have resulted from a fall.........The hearing is expected to last the rest of this week. Piampiano is not expected to decide on the request to reverse the conviction for at least two months, after attorneys have filed post-hearing legal papers."
