Leo Ackley; Anthony Ball; Shaken Baby Cases; Michigan: Bulletin: Ackley: "The problem is that shaken baby syndrome is a hypothesis, and the hypothesis has not been proven," said David Moran, with the Michigan Innocence Clinic. "I think we're going to see more skepticism, but it's a slow process and unfortunately I fear that innocent people are going to be convicted for a while." Ball: "Anthony Ball's attorney also tried to raise the issue that it is not a valid condition, but a judge ruled the science behind the medical findings can be used in his case. Jury selection in the case was postponed Wednesday and won't resume until December, in the 2014 murder of his fiancee's 20-month-old daughter Athena." (WWMT): October 20, 2016;
"A Battle Creek man was convicted Thursday for the second time in the death of his girlfriend's young daughter. It took the jury two days to find Leo Ackley guilty in the death of Baylee Stenman.
Doctors say Baylee died from abusive head trauma. In the original trial, they also considered the effects of shaken baby syndrome. Ackley's lawyer, and lawyers from the Michigan Innocence Clinic question the scientific proof of the condition. "The problem is that shaken baby syndrome is a hypothesis, and the hypothesis has not been proven," said David Moran, with the Michigan Innocence Clinic. "I think we're going to see more skepticism, but it's a slow process and unfortunately I fear that innocent people are going to be convicted for a while. Another trial involving a suspected death by shaken baby syndrome will get underway soon in Calhoun County. Anthony Ball's attorney also tried to raise the issue that it is not a valid condition, but a judge ruled the science behind the medical findings can be used in his case. Jury selection in the case was postponed Wednesday and won't resume until December, in the 2014 murder of his fiancee's 20-month-old daughter Athena."
