Robert Roberson: Death Row; Texas; Bulletin: He is expected to appear in court this morning (Tuesday September 15) two days before his scheduled execution, KSLA reports, noting that, "Robert Roberson is scheduled to die by lethal injection Oct. 17, 2024, unless courts or Texas Gov. Greg Abbott intervene."…"This is for a hearing on a motion filed by Roberson and his attorney citing what they call the invalid assignment of a retired judge to his case. They accuse her of bias, saying she should be removed, which would mean the execution warrant she signed would be considered unlawful."

GIST: "KSLA News 12 has learned that a Palestine man on Texas’ death row will appear in court Tuesday (Oct. 15), just a couple days before his scheduled execution.

Robert Roberson is due in an Anderson County courtroom at 10 a.m.

This is for a hearing on a motion filed by Roberson and his attorney citing what they call the invalid assignment of a retired judge to his case.

They accuse her of bias, saying she should be removed, which would mean the execution warrant she signed would be considered unlawful.

Roberson has long maintained his innocence in connection with the death of his 2-year-old daughter.

And advocates backing him say the “shaken baby” theory used against him is “junk science” that’s no longer even allowed to be used in court.

“The shaken baby syndrome, abusive head trauma hypothesis that was used against Mr. Roberson is not science, plain and simple,” Kate Judson said.

Butted Wharton said, “I will be forever haunted by my participation in his prosecution, his arrest and prosecution. He is an innocent man.”

As of now, Roberson’s execution is set for Thursday night."
