"With the final seven slots of the jury filled during the morning, the prosecution and defense presented their opening statements Monday afternoon in the murder trial of Nagee Green. Green, 23, of Freeville, is accused of fatally stabbing a 19-year-old Ithaca College student to death following a party on Cornell's campus last August. Green has pleaded not guilty to second-degree murder, first-degree manslaughter and second-degree assault in the death of Anthony Nazaire. During the prosecution's opening statement in Tompkins County Court, Assistant District Attorney Eliza Filipowski revealed Nazaire was stabbed only once — a fatal wound to the chest. Green is also accused of stabbing Raheim Williams three times. Filipowski, who is prosecuting the case along with District Attorney Matthew Van Houten, told jurors Green's intent began when he put a knife in his pocket before heading out the door. She detailed the events outside a party which provoked several small fights, including an eventual encounter between Green and the victims. Filipowski said Nazaire went to help Williams fend off Green, but after throwing two punches, Nazaire collapsed on Williams' leg. Williams then noticed he had been stabbed three times and needed medical assistance. The prosecution also discussed a 3-hour interview Green conducted with police, which will be shown to the jurors. Filipowski called the interview "crucial" and said Green can be heard saying "I took the knife out and was holding it in my hand" and "I remember trying to stab Anthony when I was trying to get up." Following the prosecution's statement, defense attorney Joseph Joch filed a motion to dismiss both charges on the indictment, claiming the prosecution failed to detail the charges in the indictment and did not touch on criminal intent. Judge John C. Rowley said he will review the statement Monday night and had the defense present their opening statement. Joch called the prosecution's story a theory and accused them of cherry picking details to pin on the defendant. Joch said Green was bullied by highly trained interrogators during the 3-hour interview. Joch said Green's words were twisted and Green meant it might be him, that it was possible. Joch referred to Snapchat videos that allegedly show Green with a knife, but said that is not a reason to say he murdered someone. He also said the videos are chaotic and grainy. Both the defense and prosecution said nobody witnessed the actual stabbing, and Joch claims a witness saw another person with a knife with a different description than Green...The prosecution will begin presenting its case Tuesday."
