15 of David Camm's third murder trial began with testimony from Charles
Boney's girlfriend at time of murders, Mala Singh Mattingly. Boney is already serving a life sentence for the murders of Kim, Jill and Brad Camm. Prior to testimony Tuesday, the defense requested a mistrial and prohibition of any retrial. Mattingly
was set to testify last week, but that day attorneys discovered a
police statement she made in 2005 and wanted time to review it. Camm's attorney,
Richard Kammen, said had they known about the letters, they would have
done things differently and the only real remedy is mistrial. Kammen alleged prosecutorial misconduct by second prosecutor Keith Henderson saying he deliberately withheld evidence.........Judge Jonathan Dartt said he will take the motion for mistrial under advisement.........Mattingly said the night of the murders, Boney left to meet a friend. She said he left at 6 p.m. and woke her up after midnight and he was breathing really hard, excited somewhat and hyper. Mattingly
said Boney unwrapped a jersey and it had a gun in it. She said she had
never seen him with the gun before. He also had a scrape on his knee. Mattingly said she was very scared by the gun and told him to put it away. She said he always carried backpack, too, but she never knew what was inside.'
