Bulletin: Douglas Prade: Ohio; The imprisoned former Akron police captain fighting for a new trial in the 1997 death of his ex-wife, has dropped his federal lawsuit against the city of Akron. ........ The statement, issued by the firm Loevy & Loevy in Chicago, says the suit's withdrawal is only temporary and that Prade can refile once the criminal case is completed. The jury found him guilty, in part, because of expert testimony by a forensic dentist matching him with the bite mark. But Common Pleas Judge Judy Hunter exonerated Prade in January 2013 because DNA evidence from another person was found on his ex-wife's body.
Douglas Prade, the imprisoned former Akron police
captain fighting for a new trial in the 1997 death of his ex-wife, has
dropped his federal lawsuit against the city of Akron. Prade dropped the suit, which accuses city police of manipulating
witnesses, fabricating and destroying evidence and lying, because his
murder case is still pending in Summit County Common Pleas Court,
according to a statement issued Friday by his lawyers. He requested that the suit be dismissed last week, and U.S. District Judge Sara Lioi granted the request Friday afternoon. The statement, issued by the firm Loevy & Loevy in Chicago, says
the suit's withdrawal is only temporary and that Prade can refile once
the criminal case is completed.........Prade, 69, is at the Allen Correctional Institution in Lima. He is
serving a life sentence for aggravated murder after a jury found him
guilty in 1998 of gunning down Margo Prade, a physician, outside of her
medical office. She was shot six times at close range, and the killer
bit through her lab coat into her arm. The jury found him guilty, in part, because of expert testimony by a
forensic dentist matching him with the bite mark. But Common Pleas Judge
Judy Hunter exonerated Prade in January 2013 because DNA evidence from another person was found on his ex-wife's body..........Common Pleas Judge Christine Croce will hold a hearing June 12 on whether Prade should receive a new criminal trial."http://www.cleveland.com/court-justice/index.ssf/2015/05/akron_cop_douglas_prade_drops.html
